(1) If the investigation committee determines that the health of the person who received the vaccine has been seriously affected due to the vaccination, the agency or organization from which the vaccine was given shall treat such person and pay compensation.
(2) If the investigation committee determines that a person has suffered serious physical damage or death due to a vaccination, the committee shall provide compensation to the person in case of dismemberment and to his next of kin in case of death from the agency or institution that provides such vaccination.
(3) According to sub-sections (1) and (2), the basis for providing compensation shall be as prescribed.
